Are there lemon laws in Illinois for used vehicles?

November 10, 2010 - 12:42 am 1 Comment

My husband and I bought a 1999 Ford Windstar in May of 2006, six days later it was in the shop because the check engine light came on. The dealership ( JD Byrider) “fixed” the problem. The check engine light came on again shorlty after. They have replaced the o2 sensor, the intake manifold, flushed the cooling system, checked the Serp belt, checked the anti freeze, checked the fuel pump, replaced the upper intake gasket, isolator bushings, valve cover, pcv hose, pressure regulator hose.
I still have the problem. We just had Ford do a diagnostic test on it, after I called Ford myself. It went back to JD Byrider and they still didn’t fix it. I got my van back at 2pm yesterday and at 4pm the damn check engine light was on again!!

I called the service mgr, and he said to bring it in tomorrow. I then talked to the general mgr, and he was a prick!! Told me there is nothing more they can do. This van is under a extended warranty.

What happens to a person legally if they destroy a used lemon car that has had six major repairs (and still is unreliable) but still owes on it- other than it going against credit?

Are there any kind of “lemon laws” for apartments?

November 9, 2010 - 4:53 pm 1 Comment

I moved into my apartment at the beginning of November last year. And since then the refrigerator and dishwasher had to be replaced. We had a leaky tub and found out that no trap had ever been installed causing a tremendously foul odor and attracting flys. We agreed to have the landlord use our security deposit towards new carpeting because the previous tenant’s cat had sprayed and even though they were supposedly cleaned, the smell was evident. Now the straw that broke the camel’s back: our air conditioning unit is leaking gross moldy water onto our new carpeting (around where the a/c unit is housed). The heating/cooling/vendor that we’ve been using for a majority of our above problems now needs his permission before they can come out for an estimate on the a/c problem. My landlord is not calling them back even though a message was left last night and the vendor is trying to contact him themselves. I’ve about had it w/ this apartment and I don’t know what to do. (2 yr. lease)
To clear up a few items: we have it documented in our lease that we are able to recoup the sec. dep. Also, frustration lies in the fact that all of these things have happened in 9 mo. time. My landlord does take care of the items unfortunately after the fact, so it’s not like he is totally neglecting the items needing fixed. So I don’t really know if I can use the defense of him not taking care of the upkeep. We have been contstantly taking pictures of the items that need fixed etc. I’m sorry I couldn’t fit in the part about the sec.dep. as I ran out of room when initially posting the question. I appreciate all of your input!

Is there any laws like anti lemon laws for home electronics?

November 9, 2010 - 2:09 pm 1 Comment

Some friends and I got a friend an Xbox 360 for Christmas last year. Since then she has sent it back SIX times for the same reason (open tray error). It started after the return policy had expired, but still under warranty for Xbox. I am tired of sending back and I want something I can use to get either my money back or a new system. Also no “get a PS3!” please. Thank you.

MA Lemon Laws, Who do I contact when the dealer doesn’t budge, taxes?

November 9, 2010 - 4:39 am 1 Comment

Hi, I am asking a question for a friend who bought a really crappy GM product 2001 Pont. Sunfire with a warranty for state inspection or 7 days. It over-heated the first day she bought it. The dealer was nice about everything and replaced the cap to the coolant res, which fixed the over heating problem. Then when we went to get it inspected monitors weren’t ready, tires were bad and an exhaust leak, we were told to drive about 100 miles to get monitors ready and to get dealer to fix the other problems, on the way to the dealer, check engine light came on, so the monitors were up. When we got to dealer, he was again very nice, took the car in, fixed everything. Went back to inspection 2 days later, failed again, monitors weren’t ready, exhaust leak still existed (I think the dealer mearly replaced the muffler). So we drove it until the monitors were ready, which was when the check engine came back on. It has been back to the dealers 11 times since. Every time the same check engine problem. Now the dealer is starting to be rude to my friend about the problems, raising his voice over the phone and the like, being cold when we drop off the car, and since the first problems the rotor is starting to make rubbing and skreaching noises, which we alerted the dealer about, and it was never fixed. So today we are going asking for a replacement vehicle (It’s easier than dealing with a refund, I don’t want another car from them, but whatever) or a refund. But the main question is, who do I contact if the dealer doesn’t want to take it back for give a refund? My dad said something about attorney general of our state, but I am not positive. We don’t really want to go to court but this guy is sleezy enough that it might come down to it. Also, ho do we go about getting taxes back for the car? Does the dealer give them to use, and then he fill out a form or something? Or do we have to go to the registry and do the ol’ back and forth with them? Any real help would be appreciated, the car still isn’t inspected because it is at the dealer every 1 out of 5 days, so the warranty is still intact. Please do not comment if you have nothing of use to say. Thank-you everyone -Damian.

I have a question about Lemon Laws in Va?

November 9, 2010 - 1:14 am 1 Comment

My mom just got a used vehicle and has only had it a few days. The check engine light is coming on, it is idling rough, running rough, the gas gauge doesn’t work right, and other things. Of course when she got the vehicle she didn’t have any problems, it wasn’t until she went to drive it 2 hours HOME that she started to have problems!! Starting with breaking down on the side of the highway because of the broken gas gauge!!

She is wanting to know what her options are. She doesn’t want to mess with it while her husband is telling her it isn’t any big deal that she just needs an alignment and a tune up. That doesn’t sound right and since she just got the car and nothing was wrong with it when she got it shouldn’t the place where she got it should be paying for all that???
