Voting Question: used car lemon laws or return of a used car?
I bought a 2002 explorer on may 1st. on may19th i took it into the dealers referred mechanic shop. they had it for 5 days. it needed a trans, trans mouont, u joints, hose, wheel bearings, belt and tensioner. the warranty covered it. it also needs a exhaust system and struts they did not cover. I paid a 25 dollar deductible. Driving it home on the day I picked it up it broke down. I had it towed. It was the holiday weekend so I did not contact anyone until the following tues. they picked up the car. It was towed at their expense (after much debate) and now they say the fuel pump needs repaired. They will have the car until next WEds. (totaling 16 days of a nonworking car) After much debate with the warranty company they are going to repaitr everything else also, except the studded tires that I found out after purchase are illegal in OH. The warranty company and mechanic have ben wonderful. The dealer is full of_____. Now I am fighting with the finance company. I explained to them the problem and told them I had all intention of paying for the car. (I pay every two weeks) My first payment was made and my second payment is a week late. I want to start paying for the car once I get it back next week. They say no way they are going to garnish me (which I know is crap cuz first they need to repo the car and my payment is only a week late). Can anyone offer advice legally and personally. Thank you.
