Wisconsin lemon law was formulated to help consumers who buy defective vehicles which are commonly known as lemons. Therefore, a lemon is a vehicle that has not responded to at least four times of repair under the Wisconsin lemon law. You will know that the vehicle is a lemon if it does not provide service for more than 30 days which do not have to be consecutive. The lemon law covers new cars, trucks, motorcycles and motor homes. Used cars, mopeds and trailers are some of the vehicles that are not covered by the Wisconsin lemon law. If you are certain that you are a lemon car owner in Wisconsin, there are several steps that you need to follow and they include the following.
Naturally, the first thing that you will do is to take the care to the repair shop. You should be careful to store every repair order or any other relevant document about the repair. At this particular time, you need to be careful not to alter anything in the vehicle. This will go a long way to ensure that the manufacturer does not blame you for alteration. You will then have to write to the manufacturer and inform him of the problem with the vehicle. You will be providing a chance for him to repair the lemon. Wisconsin lemon law requires that you give the manufacturer a reasonable period to repair the vehicle.
If the repairs fail, the car dealer or the manufacturer is required to offer a replacement or a refund. When they make their offer, you can take or refuse it. However, if they are not willing to do anything, your next option is to seek justice from from the arbitration programs that are available. The manufacturer sponsored program is worth trying and all you need to do is to present your case and have a mediator rule. You might feel that the arbitration might not be fair but, the idea is that you are putting forward your concerns which will have to be weighed by the mediator. If you feel that the program will not help, you simply do not have to go through it.
The other program that you need to consider is the government sponsored program which will be an informal hearing that will give you a forum to air your views and present your case in the best way possible. Many cases find a solution at this stage and it would not be wise to ignore them. Some of the advantages of using this informal method of dispute settlement is that they do not cost a lot of money and unlike court hearings, they do not consume a lot of time. Therefore it is advisable to give every option a try before going to court. When you have failed to have a favorable ruling with all options, you can file a civil suit in a court of law. You will therefore need the direction of a good lawyer who can guide you to acquire the justice that you want
